Board puts social club plans on hold

26-year-old pool table ordinance to be reviewed

June 19, 2002 - The Lincolnton Planning Board tabled a request from T & T Investments to open a private social club in the Northgate Shopping Center until a review of a 1976 ordinance can be completed.

Mark Carpenter, city zoning administrator, told the board the club would include dancing, billiards, darts and televisions.

It would be open from 2 p.m. until 2 a.m., seven days a week. Carpenter said the applicant suggested having an off-duty police officer present during the later hours.

Requirements and compliance were met, Carpenter said, and staff’s recommendation was to approve the request with some conditions.

One of those conditions was that the club comply with the Pool and Billiard Ordinance, adopted in 1976.

This ordinance says pool tables cannot be used after midnight, on Sundays or when alcohol is present.

Plans for the club include alcohol. All necessary alcohol permits would have to be obtained.

David Kuss, owner of the property, said that under present laws governing the sale of alcohol, the club would have to serve food to operate.

“We didn’t want to get involved with food,” he said.

Kuss said there might be some discrepancies in the billiards ordinance.

City Planner Steve Gurley said he wasn’t aware of the ordinance until recently.

“It may need modification,” Gurley said.

Carpenter said Kuss will probably have to go before the city council and request that the ordinance be amended or modified.

Gurley suggested that the board table any action until more information is available.

One resident spoke out against the proposed club. Mark Harrill spoke on behalf of his sister, Sara Call, who lives across the street from the property.

“It would not be a good thing for the community,” Harrill said. “She’s raising her vote against it.”

The application will come before the city council at the July 11 meeting.

In other business, the planning board will recommend that city council deny a rezoning application from Robert Gates.

Gates requested that 1.1 acres of land located at the southwest corner of the intersection of South Aspen Street at Policarp Road be rezoned from Residential-8 to Neighborhood Business.

Gates told the board he originally planned to put duplexes on the property.

“I felt like the market was saturated (with housing),” Gates said. “I’m looking at other options.”

Gates said he is considering a laundromat or car wash, among other ideas.

“That area is growing,” Gates said, noting that N.C. 150 will soon be cutting through the area.

Gates said the area is surrounded residential developments, and he wants to build a business to benefit the residents.

“I just want the opportunity to broaden my horizons in that area,” Gates said.

Laura Gregory spoke against the proposed rezoning and told the board this kind of development is something to avoid.

“Just because (N.C.) 150 is coming does not mean we have to change our focus and planning as a city,” Gregory said.

She said the area will be a gateway to the town, and the city should take pride in the impression given.

This will also come before city council for public hearing at the July 11 meeting.
